This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from caribeheart.com (the “Site”).  This website is operated by Caribeheart. Throughout the site, the terms “we”, “us” and “our” refer to Caribeheart. Caribeheart offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

1. Personal Data We Collect

a. Personal Data We Collect About You
Personal Data is any information that relates to an identified or identifiable individual. The Personal Data that you provide directly to us through our Sites and Services will be apparent from the context in which you provide the data. We obtain this data directly from you when you order products and services (e.g. the size you select) and when you provide us that information (e.g. when you create an account). We may use this data to personalize our goods and services to you, market to you, analyze other data we collect, identify other potential customers (e.g. determine how many customers are a certain size), and develop new goods and services. 

 In particular:

  • When you register for a Site account, we collect your full name, email address, and account log-in credentials.
  • When you fill in our online contact form to contact our support team, we collect your full name, email, order number, and anything else you provide us in the contact form.
  • When you use the “Remember Me” feature of Site Checkout, we collect your email address, payment card number, CVC code, and expiration date.

When you respond to Site emails, weblogs, web forms, registration for an event, newsletter signup, or surveys, we collect your email address, name, and any other information you choose to include in the body of your email or responses. If you contact us by phone or vice versa, we will collect the phone number you provide to the Site. We may collect additional information to verify your identity when responding to inquires.

b. Browser And Device Data
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, country, device type, operating system and name of version, internet browser type, device manufacturer and model, language, plug-ins, add-ons, screen resolution, the language version of the sites you are visiting, and some of the cookies that are installed on your device.

We collect Device Information using the following technologies:

As you browse the Site, we collect information about the individual web pages or products that you view, links clicked, time spent on the site, language preferences, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”.

Additionally, when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information [including credit card numbers, debit card numbers, bank account information, or third parties (e.g. Paypal, Amazon Pay, Apple Pay, Google Pay, Shop Pay, and Klarna)], email address, phone number, purchase amount and date of purchase. We refer to this information as “Order Information”.

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

2. How Do We Use Your Personal Information?

a. Our Products And Services
We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to: 

- Communicate with you;
- Screen our orders for potential risk or fraud; and
- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
- Identify other potential customers (e.g. “look-alike” customers).
- Develop new goods and services.

b. Behavioral Advertising
As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. c. Marketing And Events-Related Communication 
We may send you email marketing communications about Site products and services, invite you to participate in our events or surveys, or otherwise communicate with you for marketing purposes, provided that we do so in accordance with the consent requirements that are imposed by applicable law. For example, when we collect your contact details through our participation at trade shows or other events, we may use the information to follow-up with you regarding an event, send you information that you have requested on our products and services and, with your permission, include you on our marketing information campaigns.

d. Security And Retention
We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

We do not sell or rent Personal Data to marketers or unaffiliated third parties. We share your Personal Data with trusted entities, as outlined below.

  • Exercising the right to know. You may request, up to twice in a 12-month period, the following information about the personal information we have collected about you during the past 12 months:
    • the categories and specific pieces of personal information we have collected about you;
    • the categories of sources from which we collected the personal information;
    • the business or commercial purpose for which we collected the personal information;
    • the categories of third parties with whom we shared the personal information; and
    • the categories of personal information about you that we disclosed for a business purpose, and the categories of third parties to whom we disclosed that information for a business purpose.
  • Exercising the right to delete. You may request that we delete the personal information we have collected from you, subject to certain limitations under applicable law.
  • Exercising the right to opt-out from a sale. You may request to opt out of any “sale” of your personal information that may take place. As described in advertising, we do not use, share, rent or sell the Personal Data of our Users’ Customers for interest-based advertising. We do not sell or rent the Personal Data of our Users, their Customers or our Site visitors.
  • Non-discrimination. The CCPA provides that you may not be discriminated against for exercising these rights.

c. Your Data Protection Rights 
If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact form or address found below.

Additionally, if you are a European resident, we note that we are processing your information to fulfill contracts we might have with you (for example, if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including Canada and the United States.

d. Data Retention
When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

We also retain Personal Data to comply with our tax, accounting, and financial reporting obligations, where we are required to retain the data by our contractual commitments to our financial partners, and where data retention is mandated by the payment methods that we support. Where we retain data, we do so in accordance with any limitation periods and records retention obligations that are imposed by applicable law.

Your Personal Data is only accessible to a limited number of personnel who need access to the information to perform their duties. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account and/or information has been compromised), please contact us immediately.

e. Process for exercising data protection rights

We will comply with your request to the extent required by applicable law. We will not be able to respond to a request if we no longer hold your Personal Data. If you feel that you have not received a satisfactory response from us, you may consult with the data protection authority in your country.

f. Do Not Track
Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser. Do Not Track (DNT) is a privacy preference that users can set in some web browsers, allowing users to opt-out of tracking by websites and online services. At the present time, the World Wide Web Consortium (W3C) has not yet established universal standards for recognizable DNT signals, and therefore, we do not recognize DNT.

g. Links To Other Websites
This Site may provide the ability to connect to other websites. These websites may operate independently from us and may have their own privacy notices or policies, which we strongly suggest you review. If any linked website is not owned or controlled by us, we are not responsible for its content, any use of the website, or the privacy practices of the operator of the website.

We may need to verify your identity before responding to your request, such as verifying that the email address from which you send the request matches your email address that we have on file. Additionally, if you are conducting business on the Site using a third-party provider, please direct your requests directly to the third-party provider with whom you shared your personal information.

4. Use By Minors 

a. Under age 13 
The Site is not intended for individuals under age 13. We do not want to and do not knowingly collect any data from people under age 13. If we learn that we collected any such data, we will take all reasonable measures to delete that information and not use it for any purpose (except where necessary to protect the safety of the child or others as required or allowed by law). b. Under age 18.
People under 18 years of age may have data that they provide to us through our website deleted by sending an email to support@caribeheart.com requesting the deletion or by using the mailing information below. Please note that, while we make reasonable efforts to comply with such requests, the deletion of your data does not ensure complete and comprehensive removal of that data from all systems.
